Circular Seller Terms
Version 2026-07-13. Circular is the pre-loved resale program of Freedom Rave Wear (“FRW”, “we”, “us”).
By listing an item on Circular you agree to these terms. They are between you (the “Seller”) and FRW. This is our program policy, not legal advice.
1. Seller Terms
1.1 Eligibility (US only)
Circular selling is available only to sellers located in the United States with a valid US bank account. You must be at least 18.
1.2 Limited payment agent
You appoint FRW as your limited agent for the sole purpose of receiving and holding funds from buyers on your behalf for items you sell on Circular, and remitting those funds to you per these terms. A buyer’s payment to FRW for your item satisfies the buyer’s payment obligation to you in full, whether or not FRW has yet remitted the funds to you. You are responsible for delivering the item to the buyer. FRW is not the buyer or the seller of your item. FRW facilitates the transaction and provides the marketplace.
1.3 Payouts and timing
When your item sells you choose how to be paid:
- FRW store credit (recommended): 110% of your sale price, issued as FRW store credit usable at freedomravewear.com. No selling fee.
- Cash: your sale price minus a 20% selling fee (a 15% fee applies during any founding-seller promotional window shown to you at listing), paid to the US bank account on your connected Stripe account.
Payouts release after the item is delivered and a 72-hour buyer review window has passed with no open claim. A buyer may confirm receipt to release sooner, but never before 72 hours after delivery. You are always credited the full sale price regardless of how the buyer paid; FRW absorbs any buyer store credit or discount applied at checkout. The 110% credit is 100% of your sale price plus a 10% promotional bonus; the 10% bonus applies only to the portion of the sale the buyer funded with new payment (not with existing store credit).
1.4 Shipping
When your item sells you receive a prepaid shipping label. You must ship within 7 days using that label. If you do not ship in time the order is cancelled, the buyer is refunded, and a strike is recorded. Ship the exact item as described and photographed, packaged to prevent damage in transit.
1.5 Item accuracy and photos
Your listing must accurately describe the item’s brand, size, condition, and any flaws. You represent that you took the photos in your listing or otherwise have the right to use them, and you grant FRW a license to display them in connection with your listing and its promotion. For items that are not FRW products you must use your own original photos; official brand or stock imagery is not permitted. FRW stock imagery is available only for verified FRW items matched to your purchase history.
1.6 Prohibited and authentic items
List only authentic items you own and have the right to sell. Counterfeit, unsafe, stolen, or otherwise prohibited items are not allowed and will be removed.
1.7 Cross-listing
You may list your item elsewhere, but if you do you are responsible for keeping availability in sync and removing it from Circular promptly if it sells elsewhere, to avoid cancelling a Circular buyer.
1.8 Refunds, chargebacks, and recovery
If a buyer is refunded (including under the FRW Guarantee), a claim is decided in the buyer’s favor, or a payment is charged back after you have been paid, you authorize FRW to recover the corresponding amount by (a) deducting it from your current or future Circular proceeds, (b) reversing the related Stripe transfer, and (c) reversing the related FRW store credit, including allowing your credit or payout balance to go negative and netting it against future sales. You remain responsible for any shortfall.
1.9 Cancellations and strikes
You may cancel before shipping; the buyer is refunded and the label voided. Repeated no-ships, misrepresentation, or policy violations may result in payout holds, strikes, or removal from Circular.
1.10 Taxes
You are responsible for any taxes on your sales. FRW (through Stripe) may be required to collect your taxpayer information and issue you a Form 1099-K based on federal and state thresholds. You agree to provide a valid taxpayer ID when requested. If you do not, cash payouts may be withheld and backup withholding may apply.
1.11 Your data and account
You may request deletion of your Circular account. We will delist your active listings, pay out or handle any balance owed to you, and delete your marketing data, while retaining transaction and tax records as required by law.
1.12 Right to refuse service
FRW may decline to offer, or may discontinue, a Circular seller account at its discretion.
1.13 Governing law
These terms are governed by the laws of the State of California. Disputes are resolved by binding arbitration on an individual basis; you and FRW waive any right to a jury trial or class action, except where prohibited by law.
2. The FRW Guarantee
Included free with every Circular purchase. This is a service FRW provides as the marketplace operator. It is not insurance and not a purchased protection plan.
- As described, or your money back. If an item arrives materially not as described, open a claim within 72 hours of delivery with photos. If we agree it is materially not as described, we refund the buyer (a return may be required).
- It arrives. If an item is lost in transit and does not arrive, we make it right with a refund.
- It is the real thing. Listings are reviewed before going live; if an item is found to be counterfeit or misrepresented, the buyer is covered.
What is not covered: buyer’s remorse, minor variations disclosed in the listing (including noted flaws), and normal signs of a pre-loved item consistent with its stated condition grade.
3. Service Fee Disclosure
All-in pricing: every price shown on Circular is the full price the buyer pays for the item, excluding only applicable sales tax and any shipping. There are no additional mandatory fees added at checkout. The displayed price includes a Circular service fee that supports operating the marketplace (including the free FRW Guarantee, buyer support, and secure payments). The service fee is itemized on the receipt for transparency and does not change the total shown. It is a marketplace service fee, not the purchase of insurance or a protection plan.
